The International Criminal Court’s Prosecutor Fatou Bensouda has condemned the Libyan authorities’ failure to arrest Mahmoud Al-Werfalli, a war crimes suspect and a major in the Libyan National Army commanded by General Khalifa Haftar.

“Since the issuance of the warrant, I have repeatedly called on the Libyan national authorities to comply with their obligation to arrest and surrender Mr Al-Werfalli to the ICC,” the UN News website quoted Bensouda as saying.

“ICC suspects who are indicted with charges of grave crimes under the Rome Statute cannot be sheltered or given refuge. They must be apprehended and face justice before the court so that their guilt or innocence can be established,” she added.

Last August, the ICC issued an arrest warrant against Al-Werfalli for committing war crimes by murdering a total of 33 persons in seven different incidents in Benghazi and the surrounding areas.

Bensouda told the Security Council on Wednesday that Werfalli has recently killed ten people and her office would be issuing yet another arrest warrant against him.

“The Libyan people deserve answers. The victims of atrocity crimes in Libya deserve to have justice done and see that it is genuinely done,” she said, calling on all states to cooperate.
