Controversy over the possibility of amnesty for Saif Al-Islam Gaddafi

Mixed news was revealed late yesterday about the correctness of a leaked document  explaining the legal opinion about whether the general amnesty law in Libya may include Saif Al-Islam Gaddafi, son of the late president.

After Sky News Arabia was informed by sources, who quoted the Libyan Ministry of Justice, that the document is “correct”, a statement later attributed to the ministry said the document is “incorrect”.

Mohammed Al-Sharef, the officer in charge of public relations and media at the ministry, told Sky News Arabia: “No authority is higher than the judiciary in this aspect, and that this request could only be investigated and decided by the Supreme Judicial Council in Libya, with which the Zintan court is affiliated.” Saif Al-Islam is being held in Zintan.

Al-Sharef explained that the general amnesty law issued and approved by the Libyan parliament in Tobruk a year ago applies to the case of Saif Al-Islam Gaddafi and the other political defendants who are currently jailed, as long as they have not been convicted by the Libyan judiciary.

On Monday, Saif Al-Islam’s new lawyers announced that they would ask the ICC to drop the charges against him since he was tried and convicted in his country.
